Members Reveal How Their Companies are Faring During the Pandemic
Thanks to all active FISD members who completed the COVID-19 Business Issues Survey from SIIA (our parent organization) during April 2020. Nearly 400 SIIA member companies of all sizes around the world, including 147 FISD members, participated. Results are already informing our short-term and long-term programming response to the pandemic on a global SIIA level and within each division. Here are highlights of the findings across divisions, and the main takeaways for FISD.
Data Localization – Seeking Feedback from the Financial Sector
We are interested in FISD members’ experiences with data localization and what they see as opportunities to improve the ability to transfer financial data. SIIA (FISD’s parent) has played a leading role in advocating for permitting cross border data flows for roughly a decade now. For example, we supported a widely cited 2014 Brookings institution study on the value of transatlantic data flows. The reason SIIA did this is that governments that impose data localization requirements effectively increase costs for businesses with no corresponding improvement in cybersecurity or regulatory access to data. The Leviathan Group, for instance, estimates that governments that impose data localization requirements increase costs of hosting data by 30% to 60% at a firm level. Unfortunately, however, many countries have imposed data localization requirements such as China most prominently but also countries such as India, Indonesia and many others. The United States used to restrict cross border data flows of financial data. However, the United States changed its policy in the United States Mexico Canada Agreement. The Agreement’s Chapter 17 on financial services contains an obligation to permit cross border data flows of financial data and prohibits requirements to store data – or even “mirror” (keep copies of data) – locally. There are also protections for algorithms and source code in the agreement. This liberal regime is coupled with the right of regulatory authorities to obtain data expeditiously in the course of legitimate regulatory oversight. SIIA is working to include similar provisions in a U.S.-UK trade agreement and a U.S.-EU trade agreement.
